What is LPA Receivership?
Under the Law of Property Act, the process of fixed charge receivership is used by lenders to recover unpaid debts from a secured loan. This typically may involve a type of mortgage or fixed charge on a commercial property. The process of LPA receivership allows lenders to gain control and ownership of a property in the event a loan is defaulted on. An LPA reciever will be appointed to act on behfalf of lenders interests if the situation requires this as an approprate course of action. Licensed insolvency practitioners can be appointed to act as receivers, though the company in receivership does not necessarily have to be insolvent. This course of action is only taken after a lender has made a formal demand to retrieve payment and the borrower has failed to respond.
An LPA receiver has the powers to assume resposnibility of the brorrower's property and act as owner, collecting rent payments, and managing the properties' insurance and maintenance requirements.
